These Terms of Service ("Terms") govern your access to and use of the website located at dataforgeai.life (the "Site") and any preliminary interactions with DataForgeAI Inc. ("DataForgeAI," "we," "us," or "our") prior to execution of a separate written services agreement. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Calgary, Alberta for resolution of disputes arising from or relating to these Terms or your use of the Site, subject to any mandatory consumer protection provisions that may apply in your jurisdiction.
DataForgeAI Inc. is a corporation incorporated under the laws of Alberta with its principal place of business at 707 8th Avenue SW, Suite 2300, Calgary, AB T2P 1H2, Canada. Business Number (BN): 853174928AB0001. We provide AI data forging platforms, feature engineering pipeline design, validation governance, feature store integration, and related professional services to organisations building production machine learning systems. We are not a marketing agency, web design studio, or general IT outsourcing firm.
These Terms apply to your use of the Site, including browsing content, submitting contact inquiries, and interacting with site features such as the cookie consent banner. They do not replace a signed Master Services Agreement, Statement of Work, or programme order form ("MSA") governing paid professional engagements. In the event of conflict between these Terms and an executed MSA, the MSA controls with respect to the contracted services.
Information on the Site about programmes, pricing, capabilities, and timelines is provided for general informational purposes and does not constitute a binding offer. Binding commitments arise only through written agreements signed by authorised representatives of both parties.
You must be at least eighteen years of age and have legal capacity to enter into binding agreements to use the Site in a manner that creates obligations. If you access the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You agree not to:
We reserve the right to suspend or terminate access to the Site for conduct we reasonably believe violates these Terms or poses risk to our systems or users.
All content on the Site — including text, graphics, logos, icons, pipeline diagrams, programme descriptions, and software code comprising the Site — is owned by DataForgeAI or our licensors and protected by Canadian and international copyright, trademark, and other intellectual property laws. The DataForgeAI name, anvil logo, and "Forge F1" designation are trademarks of DataForgeAI Inc. Unauthorised use is prohibited.
You may view, download, and print Site content for personal, non-commercial reference provided you do not modify materials and you retain all proprietary notices. No licence is granted to use our trademarks, forge module library, validation frameworks, or proprietary methodologies except as expressly set out in a signed MSA.
Feedback or suggestions you voluntarily submit through the contact form or otherwise may be used by DataForgeAI without obligation or compensation to you, provided such feedback does not include your confidential information clearly marked as such.
DataForgeAI delivers professional services including pipeline architecture, feature module development, validation gate implementation, feature store integration, MLOps advisory, and forge training. Service scope, deliverables, timelines, fees, and acceptance criteria are defined exclusively in executed MSAs and Statements of Work.
Client responsibilities typically include providing timely access to data environments, designating authorised contacts, reviewing deliverables within agreed periods, and ensuring lawful authority to share data processed through forge pipelines. Delays caused by client non-performance may extend timelines and may incur additional fees as specified in the MSA.
We warrant that services will be performed in a professional manner consistent with industry standards for ML data infrastructure work. Except as expressly stated in an MSA, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Information exchanged during sales discussions, demonstrations, and preliminary scoping may include confidential business information. Each party agrees to protect the other's confidential information with reasonable care and to use it only for evaluating or performing a potential or actual engagement. Confidentiality obligations survive termination of discussions for three years, except for trade secrets which remain protected for as long as they qualify as trade secrets under applicable law.
Confidential information does not include information that is publicly available without breach, independently developed without use of confidential information, or rightfully received from a third party without restriction.
Our collection and use of personal information through the Site is described in our Privacy Policy, incorporated into these Terms by reference. By using the Site and submitting the contact form with required PIPEDA consent, you acknowledge that you have read and understood the Privacy Policy.
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY ALBERTA LAW, DATAFORGEAI DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Site content describing forge capabilities, programme outcomes, validation pass rates, and integration compatibility is illustrative. Actual pipeline results depend on data quality, infrastructure constraints, client implementation practices, and factors outside our control. Nothing on the Site constitutes legal, financial, engineering, or professional advice. Consult qualified advisers for decisions specific to your organisation.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Scheduled maintenance and unforeseen outages may occur.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATAFORGEAI AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (C$ 100.00). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER ALBERTA LAW, INCLUDING LIABILITY FOR FRAUD OR GROSS NEGLIGENCE, OR TO OBLIGATIONS ARISING UNDER AN EXECUTED MSA WHICH ARE GOVERNED BY THAT AGREEMENT.
You agree to indemnify, defend, and hold harmless DataForgeAI and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Site, or your infringement of any third-party rights, except to the extent caused by our gross negligence or wilful misconduct.
The Site may contain links to third-party websites or reference third-party tools such as cloud platforms and open-source projects. We do not control and are not responsible for third-party content, privacy practices, or availability. Links are provided for convenience and do not constitute endorsement. Your use of third-party services is subject to their respective terms.
We may revise these Terms at any time by posting updated Terms on this page with a revised effective date. Material changes will be indicated by updating the effective date at the top of this page. Your continued use of the Site after changes constitutes acceptance of the revised Terms. If you do not agree to revised Terms, discontinue use of the Site.
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction in Alberta, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and DataForgeAI regarding use of the Site and supersede prior oral or written understandings on that subject. Professional services are governed separately by executed MSAs.
